The licence lifecycle

Obtain, amend, renew, close

Getting a licence is the visible part. Most of the risk sits in the stages after it, when details change or validity runs out and nobody tells the authority.

A specialist filing a renewed certificate into a deep-green folder.
Renewal before validity runs out.
  1. Stage01

    Obtain

It starts with applicability. Your state's thresholds and headcount decide whether a shop or office needs full registration or only an intimation. A factory licence rests on plan approvals and other prerequisite documents.

    • S&E registration or intimation
    • Factory licence, with topography plans
    • Contract labour registration under the OSH Code (formerly CLRA)
    • PCB consents, Fire NOC and other EHS licences
  2. Stage02

    Amend

A new name, a change in ownership or a change of contractors alters what the licence records. The authority reviews the application, updates its register and issues an amended certificate.

    • Name change on an S&E registration
    • Factory licence amendments
    • Principal employer registration certificate amended as contractors join and leave
  3. Stage03

    Renew

Validity differs by licence and by state. We track each renewal date, put the documents together early and follow the application until the renewed licence is issued.

    • S&E renewals, where the state requires them
    • Factory licence renewal, with plan approvals and stability certificates
    • Trade licence renewal, with tax receipts and occupancy certificates
    • Lift licence renewals and inspections
  4. Stage04

    Close

When a shop shuts, a unit moves or a licence is no longer needed, it should be closed formally. Under the OSH Code, a closure is reported within 30 days, with proof that dues are paid, and the registration is then cancelled.

    • Closure of S&E registrations
    • Surrender of licences and registrations no longer needed

The cost of non-compliance

Running without a licence is the costliest gap

A lapsed registration or a contractor without a licence is a contravention on its own, whatever else is in order.

Exposure under the law

  1. ₹2–3 lakh

plus up to ₹2,000 a day

    01No registration or licence

The OSH Code requires establishments to register and factories to hold a licence. Operating without them is a contravention, and the general penalty applies.

    OSH Code, 2020, s.3, s.119 and s.94

  2. Your offence

    not only the contractor's

    02An unlicensed contractor

Engaging contract labour through a contractor who needs a licence but does not hold one is deemed a contravention by the principal employer.

    OSH Code, s.47(1) and s.54

  3. Revoked

    or suspended

03A licence obtained on wrong facts

A contractor's licence obtained by misrepresentation or suppression of a material fact, or whose conditions are breached, can be revoked or suspended after notice.

    OSH Code, s.51(1)

  4. ₹1–2 lakh

    per omission

    04Notices and returns not filed

For omitting to furnish a required notice, return, register or report in the form and time the law sets, such as an amendment when details change.

    OSH Code, s.99

Dates and numbers

The numbers that set your calendar

Most licence dates are set state by state, so read these as the common pattern rather than the rule in every state. We confirm the rule for each of your locations before we file.

Registering a new shop or office
30days, in many states
Many states expect S&E registration, or an intimation, within about 30 days of starting business. Missing the window can bring fines and trouble with bank accounts and other licences.
S&E registration validity
1 yearor longer, by state
Some states issue registration for a year or more and expect renewal. Others give longer validity, or a lifetime registration for very small establishments.
Gumasta licence, Maharashtra
10years, at most
Maharashtra's Shop Act registration is typically valid for a year, with the option of up to 10 years depending on state rules and the fee paid.
Registration under the Labour Codes
1in place of 8
The Codes fold registrations under eight laws, among them Factories, Contract Labour, ESI and EPF, into one, and four licences into one. States are still notifying their rules, so we check what each state accepts.

What you will need

The documents authorities ask for

The exact list depends on the licence, the state and your type of entity: proprietorship, partnership or company. These are the papers that come up most often.

A consultant and a business owner reviewing licence documents in green folders at a desk.
Applications prepared with the documents each authority asks for.
  • The people behind the business

Aadhaar and PAN of the proprietor, partners or directors, and the applicant's specimen signature.

  • Proof of the premises

An electricity bill or a rent or lease agreement, with proof of ownership or tenancy of the premises.

  • Entity documents

PAN of the business entity, the trade licence and the application form the authority prescribes, with the fee.

  • Plans, drawings and test reports

A factory licence rests on plan approvals, stability certificates and topography plans. A Fire NOC needs site drawings, occupancy details and fire-fighting system data. A lift licence needs installation drawings, inspection certificates and load-testing reports.

FAQ

Questions about licences & registrations

Can't find your answer? Ask us on WhatsApp and we'll reply within 2 working hours.

What is a Shop Act licence?

It is the common name for registration under your state's Shops and Commercial Establishments Act, also called S&E registration. It makes a shop, office or service outlet legal and records its address, number of employees and working hours. After registration you keep records current and renew as your state requires.

Is a Gumasta licence the same as a Shop Act licence?

Yes. In Maharashtra, 'Gumasta licence' is the everyday name for registration under the state's Shops and Establishments law. Other states may use different names, or have a municipal body handle it. The requirement is the same, but the terms and the process vary.

How do I get a Shop Act registration?

First, check whether your establishment needs full registration or only an intimation, based on your state's thresholds and headcount. Then apply through the process your state labour department prescribes, with accurate documents. Once the certificate is issued, display it at your premises. We handle the documents, fee payment, submission and later renewals.

How do I change the name on an S&E registration?

File a name-change application on your state's Shop Act portal. Attach documents that show the new name, such as a lease deed or proof of ownership. Add proof of any change in proprietor, partner or company, and pay the fee. The authority reviews it, updates its register and issues an amended certificate.

Is Udyam registration the same as a Gumasta licence?

No. Udyam registration is for micro, small and medium enterprises under the MSME Development Act, 2006, and brings benefits such as priority sector status and easier credit. A Gumasta or Shop Act licence is the labour law registration that lets a shop or office operate. A business may need both.

How is a factory licence renewed?

The prerequisite documents, such as factory plan approvals and stability certificates, are reviewed and put in order. The renewal application is prepared and submitted to the department, which may inspect or verify before approving. We track the application until approval and monitor the next renewal date, so production is not disrupted by a lapse.

Which licences does a factory or warehouse need?

It depends on the site and what it does. Typical requirements include Pollution Control Board consents, environmental clearance, Fire and DG set NOCs, and legal metrology and FSSAI registrations. Waste authorisations can cover battery, plastic, e-waste and bio-medical waste. A lift licence and hazardous waste or chemical registrations apply where relevant, and factories also need a factory licence.

What does a Shop Act registration cost?

Government fees vary from state to state, with the number of employees, the business category, the duration of the licence and the locality. For our own fee to manage your licences, send us an enquiry with your locations.
